SEASON REGULATIONS

  • Internal rules and regulations

    • FIRST: By accepting these rules and regulations the undersigned assumes the condition of client (the "Client") of Solana del Segre, S.L. (“SdS”) and implies full acceptance and without objection of each and every rule stated herewith, as well as the rules and regulations stated in its summary or in the internal regulations approved by the D. G. Turisme de la Generalitat de Catalunya and the Solana del Segre's Internal Rules and Regulations published at the Reception of SdS. It is stated that, due to its nature and specific purpose, the right of stay and use forseen herewith does not imply in any case the rental of an area as contemplated in sections 1546 and the following in the Civil Code. Consequently, the document hereof will solely be ruled by the disposals under these private regulations, as well as by the regulations of SdS and the tourist legislation.
    • SECOND: The object is the concession by SdS to the client, who accepts this, of the right to temporarily stay in an SdS site for the temporary lodging in the said site of a unit of accommodation ("Housing"), property of the client, only during the open days between 1 January and 31 December, as stated herewith, in exchange of the payment of the contracted rate in the terms and conditions appointed. As a result of this, the client aknowledges and accepts that if at the end of the contracted time the client and SdS have not signed a new contract allowing the client to keep his or her housing within SdS for a new period of time, the client will have to withdraw his or her housing and leave the camping site free and the disposal of SdS.
    • THIRD: The camping site offers electricity (5 amp per caravan; 15 amp, with an individual meter, per module). The outdoor swimming pool will operate from 1 July to 31 August. The days when the camping is open the SdS user will be allowed to stay in the site, 24 hours a day. Solana del Segre's “Open days ” : Weekends : All weekends year round from Friday at15 h. to Sunday at 23 h. Long weekends: 6 and 8 December. School summer holidays : Christmas (but closed on 24 and 25 December)and Easter. Summer : From 24 June to 11 September, open every day uninterruptedly. During the rest of the year SdS will remain closed. When SdS is closed, the Client will not have the right to stay within the camping. Consequently, the Client understands and accepts that he or she will have to leave SdS before its closing time.
    • FOURTH: The season as a whole. This period is considered as a whole. The Client will have to pay the applicable rate in accordance to the whole period, regardless of the use he or she may make. Therefore, the client understands and accepts on purpose that if he or she decided to withdraw his or her housing from the establishment before the end of the contracted period, he or she would have to pay the remaining due amount according to the contracted price, if it were still unpaid. If the case may be that the client were late in any of his or her payments and without prejudice to resolution in section 7, SdS could deny the access to the camping to the Client and his or her family until the Client proved to have paid accordingly. Otherwise he or she would have to withdraw his or her unit of accommodation from the camping.
    • FIFTH : SdS ENTRANCE AND VISIT RULES. The right to stay during the days the camping is open which has been given to the Client, authorises solely the people defined hereunder as "Family": the signing party, his or her spouse, and their children under 25. The Client must request the appropriate permission for a visitor to enter SdS premises. A visitor can be any person other than the mentioned above and must be authorised by SdS. The client will have to pay for the visit at the applicable rate. The Client and his or her Family, as defined hereinabove, may freely enter SdS. However,with a view to control the access the clients may be asked to prove they are customers of SdS. "Visitors": All people, friends and family of the client who are not included in the groups hereinabove will be considered as outsiders at SdS and therefore, as visitors. A visit is a stay longer than 1 hour at SdS of 1 or several people visiting an SdS client during the day. Only the yearly seasonal client is granted with 15 free visits. Once they have all been used a visit will be charged at the rate of 15€ per person and day. Other seasonal clients ARE NOT granted with free visits and consequently, all visits will be charged at the rate of 6,60 €/person.
    • SIXTH: NO ACCOMMODATION SUBLEASING NOR CESSION OF STAY. While the agreement is in force, the transmission of the accommodation's possession or subleasing the lodging to third parties IS NOT ALLOWED. Likewise, accommodation must not be ceded as a whole or in part to third parties. If the Client does not comply with this obligation, SdS may deny the access to the buyers, leasees or cessionees of the mentioned accommodation. If the client sells his unit of accommodation during the season, he or she will have to withdraw his or her accommodation from SdS before its transmission. According to this agreement and for all purposes, the client's unit of accommodation is always considered movable.
    • SEVENTH: EXTINCTION, RESCISSION OR DISCHARGE OF THE AGREEMENT: If at the end of the season the Client has not removed his or her unit of accommodation, and without prejudice to any claim for any damages imputable to SdS, the Penal Clause under these regulations will be applied, and the Client will have to pay to SdS the amount of 92,00 € per day on which accommodation is improperly remaining at SdS. For the purposes of calculating the Penal Clause, the last date of the agreement will be considered as the initial date of the breach, without prejudice to the fact that SdS may claim for other indemnities resulting from the breach of these regulations. CAUSES: The following are causes for the extinction, rescission or discharge of the agreement: A) The end of the season. B) The delay on any of the payments. Delay or lack of payment of any amount due by the Client implies the automatic rescission of the Agreement within the 10 natural days following the payment's duedate, forcing the Client to remove his or her accommodation and other belongings within the following 7 days. Failure to do so, the Penal Clause under this agreement will apply, accounting the obligation's deadline as the initial breach date for Penal Clause's calculation purposes . C) Other causes of breach. In case of breach of any other point in these regulations, or of SdS's Internal Regulations, and/or Applicable Law by the Client or a Client's Family member or Visitor, SdS will ask the Client to comply with the applicable regulations in order to regularize the detected irregularity, and if within the 72 hors following the Client's notification he or she has not complied with the mentioned regulations, the agreement will be cancelled, under the agreement's Penal Clause. For the purposes of calculation of the Penal Clause, the date of the agreement's rescission will be considered as the initial date of the breach. In that case, the Client will have to remove his or her accommodation and other belongings within the 7 natural days following the extinction, rescission or discharge of the agreement. PENAL CLAUSE: If the case may be that the Client does not remove his or her unit of accommodation within the 7 natural days from his or her obligation of leaving the site, he or she will have to pay the amount of 92,00 € per day in consideration for the Penal Clause from the date indicated as the initial date of application of the said clause. If by the 15th natural day of being required to leave the site, the pitch is still being occupied by the Client's unit of accommodation or any other of his or her belongings, the Client empowers SdS to move the unit of accommodation as well as any other of his or her belongings to the place SdS may consider appropriate, and to charge the corresponding expenses to the Client.
